Westray Studios and Gallery Terms and Conditions of Sale

1.  The use of the Westray Studios web site or Westray Studios and Gallery, and placing an order indicates your acceptance of these Terms and Conditions. This does not affect any statutory rights that you may have.

2.  Description of Goods

2.1 The description and price of the goods to be ordered by the Customer are as stated on this web site (which may be varied from time to time) and is also displayed in the gallery. The supplier may not be bounded by any erroneous prices. All prices are to be construed as an “Invitation to treat” only. In the event of an error, the supplier will inform the Customer as soon as possible, and give the option of reconfirming the order at the correct price or cancelling the order. If the Supplier is unable to contact the Customer the order will be treated as cancelled. If the Customer cancels under these circumstances, and has already paid for the goods, the Customer will receive a full refund.

2.2 The goods are offered subject to remaining unsold. If on receipt of the Customer’s order the goods ordered are not available, the Supplier will inform the Customer as soon as possible, and refund or credit the Customer for any sum that has been paid by the Customer. 

2.3 In addition to the stated price, the Customer will be required to pay the delivery charge for the goods as shown at the checkout or indicated elsewhere on the web site.

2.4 The Supplier reserves the right not to supply any goods to any person for any reason and shall not be required to give such reason. In this event the Supplier will inform the Customer as soon as possible, and refund or recredit the Customer for any sum that has been paid by the Customer.

2.5 All items, paintings, prints, furniture, wood turning and pottery are photographically displayed and described in words on the web site. A purchase is based on this description and no returns or refunds will be made unless the goods arrive damaged in transit, in which case the Customer should inform the Supplier and appropriate steps must be taken to claim on the insurance.

 

3.  Price and Payment         
The price stated is in pounds sterling. Payment must be made by secure internet payment service or by prior agreement, by cheque made payable to Westray Studios. Goods will not be released until payment has cleared.

4.  Delivery and Warranty        
The price stated does not include delivery. Paintings, prints, pottery and wood turning will be sent by Royal Mail, packaged and protected as well as we deem reasonable to prevent damage. The goods will be insured for the appropriate amount. Furniture will be sent either by Royal Mail or by an Orkney Haulage Company as appropriate and the Customer will be advised of the cost prior to dispatch. The haulage fee must be paid to the Supplier or direct to the haulage company prior to dispatch. Goods will not be despatched unless they are insured.

5.  Copyright      
The purchase of a painting, print or any other artefact from this web site or gallery does not imply that the purchaser can use an image of the purchased item for commercial purposes. The copyright to any item or image remains with the artist at all times, and the artist retains the right to reproduce the image.

6.  Governing Law         
These Terms and Conditions and the supply of goods are subject to Scottish Law and the Scottish Courts will have jurisdiction in respect of any dispute arising from the contract.
